New Mexico's oil and gas industry is
facing a period of transition that promises to set the course for years to come. During the next year, a series of regulatory
matters will be decided that will provide
the foundation on which the industry will
continue its exploration and production activities. These matters will be instrumental in determining the level of production
and the impact the oil and gas industry will
have in New Mexico.
These issues likely will be resolved
where some outcomes encourage new
activity, but some outcomes hinder and discourage it. The big question is what the
mix of outcomes will be and what impacts
they will have on the companies that operate in New Mexico. While no one can see
the future, I am optimistic that the positive
forces will prove much stronger than the
negative ones.
Much of my optimism can be traced to
the leadership of New Mexico Governor
Susana Martinez. The governor has appointed knowledgeable and experienced
cabinet secretaries and other personnel in
key departments and agencies. There also
is a renewed commitment to collaboration
on developing issues. Both the Oil Conservation Division and State Land Office
have established working groups to address
new and ongoing industry issues in a more
collaborative manner with much better
channels of communication.
Five matters either are pending or under way before the Oil Conservation
Commission and the Environmental Improvement Board. All are expected to be
resolved by the middle of 2012. In addition, a ruling on the listing of the dunes
sagebrush lizard under the federal En-

dangered Species Act has been deferred
until May. Finally, 2012 likely will see additional activity with regard to possible
ESA listing of the lesser prairie chicken.
The aggregate impact of these regulatory actions may not be known for quite
some time. What is clear is that New Mexico's oil and gas
industry is working diligently to
do everything it
can to allow for
continued production of the state's resources while providing
reasonable, science-based regulation that
protects the environment. The New Mexico Oil & Gas Association's approach to
the numerous issues confronting the industry can be summed as optimism
through positive action.
OCC Rules
The OCC has completed a hearing on
a horizontal drilling rule the OCD proposed. Its staff developed the rule after
completing a working group process that
included regulators and industry representatives. The horizontal drilling rule is
expected to streamline horizontal wells' approval process. The new rule will provide
much needed enhancements to existing
rules that only contemplate vertical wells.
A final rule is expected soon.
In the rule-making process related to
disclosure of hydraulic fracturing fluids,
the OCC has completed hearings about a
rule NMOGA filed on behalf of the industry. The commission ordered the OCD
staff to draft a rule that would require hydraulic fracturing fluids to be disclosed 45
days after a well's completion. The disclosure will be done on a form that essentially matches the information posted
on the FracFocus website. Required disclosures will include the trade name, ingredients, chemical abstract service number, and maximum ingredient concentrations. The final rule is expected to be issued early this year. We hope New Mexico's proactive approach on disclosure will
help insulate us from action at the federal level.

NMOGA also has filed proposed
changes to the rules regarding production
pits and below grade tanks. This regulation, commonly referred to the pit rule, requires closed loop systems for most
drilling activities. Under NMOGA's proposed changes, lined production pits and
in-place drilling cuttings burial would be
allowed when distance to groundwater
warrants, and chloride and other chemical levels are within appropriate ranges.
The hearing on this rule is expected to begin in early 2012 with a final rule expected
by midyear.
Overall, my optimism in this portion
of New Mexico's regulatory arena is
very high. The rule-making proceedings
are progressing in a timely and orderly
fashion, and the rulings that have emerged
have been based on science and common
sense. These factors indicate New Mexico is well on its way to a stable and predictable regulatory climate.
EIB Regulations
Regulatory matters before the EIB
also are under way. The first seeks to repeal gas emissions reporting, verification
requirements and the cap-and-trade program. Hearings have been completed on
this matter and a ruling is expected soon.
The second EIB matter seeks to repeal
regulations relating to reducing greenhouse gas emissions. Hearings on this
matter began in December 2011, and a
ruling is expected in the first quarter of
this year.
Although rulings are pending, the
EIB's proceedings suggest a reasonable
chance of relief from the existing GHG
rules and regulations, which if fully implemented, would have placed the industry
at a great disadvantage when compared
with surrounding states.
Lizards and Chickens
New Mexico's oil and gas industry has
worked to allow for continued access
while protecting habitats for the dunes
sagebrush lizard and lesser prairie chicken. Many companies have signed cooperative conservation agreements on public land and cooperative conservation
agreements with assurances on private
land. These agreements with the Bureau
of Land Management and U.S. Fish and
Wildlife Service provide real dollars and
improved methods of operation to protect
habitat while allowing for continued acJANUARY 2012 225
