Court Upholds Permit
In Dispute About Well In
St. Tammany Parish, La.
NEW ORLEANS-A ruling
upholding a U.S. Army Corps of
Engineers wetlands permit sends an
important signal that the legal system
will not acquiesce to unfounded
challenges to otherwise legitimate oil
and gas development, the Louisiana Oil
& Gas Association says.
A federal judge in late December
upheld a wetlands permit the U.S. Army
Corps of Engineers awarded Helis Oil
& Gas Company to drill and complete
an exploratory well in St. Tammany
Parish, La.
The town of Abita Springs, La.,
initially filed its legal challenge against
the permit in February 2015. The parish
simultaneously is pursuing separate
litigation that seeks to kill the project by
way of local zoning authority (AOGR,
Sept. 2015, pg. 18).
According to LOGA
Communications Director Ragan
Dickens, the ruling maintains a general
consensus that there is no reason to halt
the project. "Environmentalists have
done their best at the local, state and
federal levels to stop it," he describes.
"As long as the Corps permits it
correctly and there are no wetlands
issues-which there are not-then
common sense says this is a good
project."
However, Dickens says the
situation has evolved into a public
relations battle with implications that
extend beyond a single well. "We are
excited that the courts consistently are
ruling in favor of this project, but we
really are looking at this from a
statewide perspective," he explains. "If
this well is stopped, other local
governments will play copycat. Even
if they do not try to kill projects, they
will add more difficult regulations. But
this project has gone through the
correct legal, regulatory and wetlands
processes, and this well will benefit St.
Tammany parish and the state as a
whole."
The ruling by U.S. District Judge
Carl Barbier rejects Abita Springs'
claim that the Corps incorrectly
rejected the town's request for a public
hearing and new public comment
period. It also disagrees with the
town's claim that the Corps was
arbitrary and capricious when it opted
not to require Helis' application to
include a study that considers
nonwetland sites.
According to the decision, Helis
describes the project as a vertical
exploratory well that seeks geologic
data to confirm the production of a
precise subsurface zone. The site was
