billion cubic feet of gas, and the loss of
$107 million in state tax revenue and
$570 million in royalties for mineral
owners.
Implementation of the CPP was stayed
by the U.S. Supreme Court in February
(AOGR, March 2016, pg. 107). Oral arguments are set for the U.S. Court of Appeals in September and could move the
Supreme Court to consider the case as
soon as 2017.
ROW Revisions
Dillé also expresses concern that a
new Bureau of Indian Affairs rule could
slow the right-of-way process. Operators'
and pipeline companies' ability to secure
ROWs on tribal lands is critical in moving
associated gas from stranded wells to
gathering systems, he says. "Our industry
is committed to working closely with
BIA to keep the process moving forward
in an expeditious manner," Dillé assures.
According to BIA, the new rule updates
25 CFR 169, Rights-of-Way on Indian
Land, and became effective April 21. The
bureau claims the revisions are the first
to this section of BIA rules in 30 years.
As described by BIA, the rules:
* Streamline and clarify the bureau's
process for approving ROW grants on
Indian land;
* Support tribal and allottee decisions
regarding land use;
* Increase flexibility in compensation
and valuations; and
* Protect trust property.
BIA claims the rule streamlines ROW
approvals by establishing deadlines for
bureau action on submitted proposals,
allowing survey teams access to land
without BIA pre-approval, and by issuing
an approval even in the event of an administrative appeal.
The revisions require BIA to issue a
decision "within 60 days of receiving a
complete application" and 30 days on an
"amendment, assignment or mortgage of
a ROW," the bureau's statement explains.
Spill Rules
In late June, the North Dakota Industrial
Commission formalized rules aimed at
preventing and containing well site fluid
spills, despite concerns NDPC voiced
about the regulations' cost and effectiveness.
The rules include new oil and water
gathering system bonding and pipeline
inspection requirements as well as well
site berms. Consideration will be given

to wells that have no production facilities
or storage tanks, have secondary containment, or those pumping fewer than
100 barrels of fluid a day.
According to a department statement,
its data show the number of spills that
should be contained to a pad but are not
has increased during the past three years.
The rules are scheduled to take effect Oct.
1. Operators will be required to construct
impermeable berms at least 6 inches high
around well sites and production facilities.
The industry has greatly improved its
ability to prevent, contain and clean up oil
and water spills, Ness says. "We have
worked with the state on spill prevention
and response, so I am surprised it went
ahead with these new rules," he mentions.

Waste Disposal
In July, two environmental groups
filed a court appeal seeking to force the
state to scrap its new rules allowing landfills to accept radioactive waste materials.
The appeal charges that the North Dakota
Health Council's notice of a final public
hearing on the new rules sent four days
before the hearing in August 2015 was
insufficient. An opinion by the attorney
general's office agreed, but concluded it
would be adequate to mail copies of the
meeting minutes to interested parties.
Before North Dakota revised its rules,
published reports note, disposing of waste
materials measuring above 5 picocuries
in landfills was forbidden. Operators who
sought to dispose of oil field wastes that
