Ask Governor To Enact
Injection Moratorium
WARREN, OH.-The Trumbull
County Commission has asked Ohio
Governor John Kasich to impose a
moratorium on new wastewater
injection wells in the county.
The commission points out local
governments lost the authority to
implement their own controls through
zoning resolutions in 2004 after Ohio
implemented HB 278.
The commission contends an
unintended consequence of that
legislation is the proliferation of Class
II injection wells in rural townships,
villages and cities. It points to a
September decision by the Ohio
Department of Natural Resources to
shut down two brine injection wells
operated by American Water
Management Services following a small
earthquake as a reason for the
moratorium. ODNR says seismic data
link the two Trumbull County wells to
the event.
At their June 24 meeting, Trumbull
County commissioners approved asking
for a freeze on injection well permits
until several conditions were met.
According to the commission's website,
those requirements are:
* Installation of groundwater
monitoring systems similar to landfill
facilities;
* Facilities reporting emissions
monitoring results to ODNR quarterly;
* Hours of operation limited to 7
a.m. to 6 p.m. Monday through Friday;
* Landscape plans, with a buffer
zone at least 100 feet deep, consisting
of berms, walls, trees or shrubbery; and
* Road use maintenance agreements
for all drilling activities.
Shawn Bennett, executive vice
president of the Ohio Oil & Gas
Association, says Ohio's injection
program is being run properly.
"As far as banning the entire
injection program, you are talking about
a federal program, so I don't believe the
state has the legal right to impose a
moratorium," he says. "If the state was
not running the program, then that
would force the U.S. EPA to manage
Ohio's UIC program."
Two weeks after the Trumbull
County request, the Athens County
Commission voted to ask state officials
to stop issuing new injection well
permits in that county. In the first
quarter of 2015, media reports indicate,
